TERMS OF TRADE
The Terms of Trade explain how we operate at Mossy Motors and what you can expect when working with us.
They are designed to ensure clarity, fairness, and transparency for both our customers and our team.
1. Workmanship & Care
Mossy Motors will carry out all work with reasonable care and skill and in accordance with New Zealand consumer law.
2. Authorisation of Work
By leaving a vehicle with Mossy Motors or requesting work to be carried out, the customer authorises Mossy Motors to perform agreed repairs, servicing, and any reasonably necessary diagnostic or safety-related work required to complete the job properly.
3. Parts & Supplier Delays
Mossy Motors is not responsible for delays caused by parts availability, supplier response times, specialist inspections, or circumstances outside of our control.
4. Warranty Inspections & Specialist Work
Where Mossy Motors recommends inspection, diagnosis, or repair by a specialist, supplier, or manufacturer, this recommendation is made to ensure technical accuracy, safety, or warranty compliance. Mossy Motors is not responsible for the findings, work, or timeframes of third parties, nor for any downtime, inconvenience, or associated costs arising from such referral.
If a workmanship issue is later confirmed relating directly to work performed by Mossy Motors, our responsibility is limited to rectifying that workmanship fault only.
5. Faulty Parts
Where parts supplied by third parties fail or are defective, Mossy Motors will assist in facilitating any applicable supplier or manufacturer warranty. Responsibility for the part remains with the supplier or manufacturer. Mossy Motors’ responsibility is limited to rectifying any confirmed installation or workmanship issue directly relating to the fitting of the part. Mossy Motors is not liable for losses, downtime, or consequential costs arising from defective parts supplied by third parties.
6. Vehicle Use Between Repairs
If Mossy Motors advises that a vehicle may be unsafe to operate, the customer accepts responsibility for any continued use of the vehicle between repair stages.
7. Storage & Collection
Customers are responsible for collecting their vehicle promptly once notified that work is complete. Mossy Motors reserves the right to charge reasonable storage fees for vehicles left uncollected without prior arrangement.
8. Consequential Loss
Mossy Motors is not liable for any consequential loss, business interruption, loss of income, transport costs, or other indirect expenses arising from vehicle repairs, inspections, delays, or parts supply, unless required by law.
9. Payment
Payment is due upon completion of work unless otherwise agreed. Mossy Motors reserves the right to retain possession of the vehicle until payment has been made in full, in accordance with applicable law.
10. Acceptance of Terms
Leaving a vehicle with Mossy Motors or authorising work indicates acceptance of these Terms of Trade.
